Here is a hypo situation.
I am sorry this may have been discussed before,.
If 485 from current company is denied, can I use i-140 and EAD and join a different company and have my status safe.. If so, what will be my next steps and what will jhave to be applied again. Current company , lets say will not revoke 140.

Have anybody stamped their H1 visa in UAE?
I heard a lot of people stamping in Canada and Mexico - but not any other countries.

I strongly fell you should get it fixed. Any how you have good Priority date after correction. If they dont correct then you are still lucky :)
Keep all evidences that you tried to correct it. This will help in future if any thing goes wrong from there side.

I remember reading if you travel outside the country while your AP is pending, it will be considered abandoned and you may not receive approval or any refund.

Is it possible to extend H4 status after using EAD for a person whose I-485 pending in derivative status.
I read Cronin Memo reg. dual intent "Revision of March 14, 2000 Dual Intent Memorandum"
It seems to discuss reg. using AP to enter the country and maintaining H status.
Not sure if anyone here has done the extension of H4 after using EAD.

And NSC -> TSC transfer dates, god knows how long the wait is
It's worth a wait, TSC is lot faster in processing EAD and AP after receiting than NSC.

Can someone please explain what is Form G-639 for . I googled on G-639 but it seems my case fits more on cases when this shouldn't be used. Please please someone please try to understand. All I have is my SSN and all I know is my I-140 is being filed and approved. I don't have the SRC number.

Currently on TN-1 Visa with 13 years of IT Program Management and IT Project Management, IT Governance and IT Audit experience.
Looking for a company willing and able to apply for Labor Certification in this short duration, so I can apply for I-140 and I-485 before August 17th.

Almost a good percentage of IV members are ready to file their I-140/I-485. I was one of the fortunate ones who will be able to file I485, due to the date moving from 2001 to 2003 last month for Eb3. The moment I got this happy news that I can file I-485, I celebrated by contributing $20 to IV. And my request to all of you who are in good spirits as of today due to the dates being current for I140/485, please do the same. This will help IV to continue fighting for the removal of retrogression to the best extent. I am sure all of us agree with me, that there is a long way to go in the journey of this GC. So, please contribute.

I’m confused about using the EAD. Someone please clarify me….
I already received the EAD for me and my wife. Currently, I’m in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
•Can I be in H1b and still work another job as a part-time?
------ if the part time job is using a part time H1 only then you will be H1 and dependents in H4 using EAD meaning you lose H1/4
•If my wife wants to work using her EAD does it have any effect on her h4 status?
--- her status becomes AOS pending and H4 is gone
•If my wife loose her job during the use of her EAD what will be her status?
--- she will reamain AOS pending same as while using EAD
•I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?
---- you can be self-employed and have similar job description and LC
•I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?

I just noticed that the I-140 my lawyer submitted 3 months ago to Nebraska has a typo in my DOB (21/07/2978 instead of 21/07/1978). Yes its a thousand years out! A copy of my latest I-94 and visa both showing my correct DOB were also submitted with the I-140.
Do any of you guys think I'll have the I-140 rejected, recieve an RFE, or will the Nebraska officer just use common sense and amend it himself? What do you reccomend I do if anything?

Can scanned copy be submitted to USCIS for affidavit of birth or we have to submit the affidavit in original?

You mean photocopy right? If you have scanned copy then print it and send it to USCIS. I don't think they require it in original.

Once you give out your EAD for employment your H1 status goes in limbo. I think the way to go back on H1b status is to exit the country and reenter with H1 visa and then work only for the employer who sponsored the H1b (in case something terrible happens to your AOS).
But again this is just my analysis; and I am not a lawyer.
